These terms and conditions apply to all services that Landfolk A/S, CVR 42074640, Bülowsgade 68, 3.tv., 8000 Aarhus C ("Landfolk", "us", "we" or "our") offers to you as a guest ("guest", “you” or “your”) when you/they use our platform available at landfolk.com ("Platform") for the intermediation of holiday home rentals made available directly by homeowners (“host”). When you create a user profile on our Platform and make a booking, you agree to be bound by these terms and conditions. Your booking is governed by the terms and conditions in force on the day of your booking.

We have communicated our terms as clearly as possible below. If you have any questions, please do not hesitate to contact us at support@landfolk.com.

We may modify these terms and conditions at any time, without prior notice such as (1) to improve the terms and conditions and make them clearer or easier to understand, (2) to comply with legal, regulatory and/or tax requirements, (3) when we make changes to our services or our business model, or (4) for security reasons. If we make changes that affect your rights or obligations, we will notify you with reasonable notice, unless applicable legal, tax or security requirements urgently require such changes. In this case, we will inform you as soon as possible. By continuing to use our Platform after any amendment to the terms and conditions becomes effective, you accept the updated terms and conditions.

1) Intermediation

The Platform makes private rental of holiday homes easy and transparent for both hosts and guests. Landfolk acts as an intermediary between hosts and guests relating to the rental of holiday homes. When you book a holiday home on our Platform, an agreement is concluded directly between you and the host for the rental of this host's holiday home for the chosen period and on the particular rental terms set out on the listing on the Platform. Moreover, the rights and obligations between you and the host arise from those terms and these terms and conditions. You acknowledge and agree that we are not a party to the contractual relationship between you and a host. Landfolk is not acting as an agent or representative for you or for the host.

2) Description of Services

We offer you the right to use the Platform allowing you to search for, consult a list of holiday homes and make booking requests of holiday homes listed on our Platform, and if applicable agree upon rental terms of the host’s holiday home through the secure private chat available on the Platform (the “Services”).

We accept no responsibility for, and will not become involved in, any disputes between you and the host, nor will we be responsible for the host’s compliance with the law in force at any time.

Notwithstanding the above, you acknowledge that Landfolk has the right, but does not have any obligation, to monitor the use of the Platform and verify information provided by you and/or the host except as expressly provided herein regarding the holiday home. You agree to cooperate with and assist Landfolk in good faith and to provide Landfolk with such information and take such actions as may be reasonably requested by Landfolk concerning any investigation undertaken by Landfolk regarding the use or abuse of the Platform.

3) Prerequisites

By using the Services, you hereby represent and warrant:

  • to have read these terms and conditions and to accept them fully

  • to be 18 years old or over 18 years old unless more protective laws require you to be older for you to be bound by the terms and conditions, without parental consent, the minimum age shall be the age provided under said laws

  • to have the technical skills and devices required to use the Services

  • to have a valid email address

  • not to have been banned by Landfolk from using the Services

  • to be the holder of a single Account, as defined below.

Youth groups

To book a holiday home on the Platform, you must be at least 18 years old. If the holiday home is to be booked for a group of more than 3 people, all occupants must be at least 25 years old unless otherwise agreed with the host, or the holiday home is to be used for a family stay (parents with children and adolescents).

4) User account

Account creation

To book a holiday home, you must create a personal and private account on the Platform (the “Account”). You must provide a valid email address to register on the Platform.

When making a booking request or a direct booking of a holiday home, you must provide the following information for us to create a user profile on the Platform:

  • First and last name

  • Email address

  • Home address

  • Phone number

If you choose to make a user profile before making a booking request or direct booking, the following information is required by Landfolk:

  • First and last name

  • Email address

Information marked with an asterisk (*) is mandatory.

We recommend that you only create one Account per individual.

You acknowledge that you are responsible for providing Landfolk with error-free information and undertake to update this information when necessary. In particular, you undertake not to use a false identity. If any of the mandatory information provided proves to be false, incomplete, obsolete or offensive, Landfolk reserves the right, without prior notice, to suspend or close your Account, and to prevent access to all or part of the Services.

You can also sign up or log in to access the Platform through your Google or your Facebook account. In this respect, you authorize Landfolk to access and retain any information, data, text, messages, photographs, and/or other information and documents accessible through the Platform, stored in your Google or Facebook account, to integrate them into the Platform to complete your registration, subject to your privacy settings on Google or Facebook.

Your relationship with Google or Facebook is governed solely by the agreement between Google or Facebook and you. Landfolk disclaims any responsibility or liability for any communication with Google or Facebook of personally identifiable information in violation of the privacy settings you have set on your Google or Facebook account.

Access to the Services

To sign up or log in to your Account you must enter your email address and password. Access to your profile is reserved for you. Any use of your login information constitutes an irrefutable presumption of use of the Platform by you.

We strive to have as much uptime as possible. The Services are accessible 24 hours a day, 7 days a week, subject to maintenance operations or emergency measures.

Landfolk reserves the right, without prior notice or compensation, to temporarily or permanently close the Platform or access to one or more Services, in particular (1) to carry out updates, maintenance operations, modifications or changes to operational methods, service providers, servers and accessibility times; or (2) if Landfolk reasonably believes that (a) use of the Services by any a person will or could disrupt our operation, or the infrastructure used to provide the Services, (b) there is a security threat or attack on the Services or other event that may create a material risk of the foregoing, (c) a person is using the Services for fraudulent or illegal activities, without this list being limited.

Landfolk cannot be held liable for any unavailability of the Services, whether voluntary or involuntary, such as if such unavailability is due to external factors including, but not limited to, technical reasons, network congestion, misuse of online Services, failure of Internet service providers and communication and telecommunication operators. Likewise, Landfolk cannot be held responsible for damage to the operating system and functionality of the hardware used as a result of interruptions or disruptions to the Services. Landfolk is therefore bound, by the standards and practices in the sector, by an obligation of means in the performance of the Service.

Landfolk reserves the right to complete or modify, at any time, the Services available such as to consider technological developments or for security reasons.

You must notify Landfolk of any failure of the Services as soon as you become aware of such failure or unavailability by sending to Landfolk an email to support@landfolk.com.

Security

You are responsible for the confidentiality and security of your login information, except in a case of technical failure strictly attributable to Landfolk or in case of force majeure.

You are strongly advised to change your password at regular intervals and to use a secure password, avoiding easily identifiable combinations. Landfolk may impose certain conditions on passwords and/or an expiry date on your password, after which you will be invited to change your password.

If you lose your password, Landfolk has set up a password recovery procedure, enabling you to create a new password.

You undertake not to disrupt the proper functioning of the Platform. In particular, you agree not to interfere with the proper functioning of the Platform, introduce or try to introduce viruses or any other software or technology harmful to the Platform, the Services offered or to Landfolk. You also agree to take all appropriate measures to protect your own data and/or software from contamination by viruses and malicious software.

In particular, you agree not to carry out any operation aimed at saturating a page, bounce operations or any operation which has the effect of hindering or distorting the operation of the Platform, or which would impose a burden on the Platform.

Account suspension

Any breach of your obligations under the terms and conditions may result in the suspension of your Account immediately, without prior notification. You may also be banned from using the Services. This provision is without prejudice to any other remedy Landfolk may have under applicable law or these terms and conditions.

Account deletion

You must notify us, If you want to delete your Account, by sending your request to Landfolk Support at support@landfolk.com.

Your Account may also be deleted by Landfolk, on the grounds provided within these terms and conditions.

Landfolk shall in no event be liable for the consequences of suspension or closing of your Account.

If Landfolk closes an Account due to non-compliance with the terms and conditions, you undertake not to create a new Account without prior authorization from us.

You shall remain liable for any use made of your Account before its closing.

5) Reservations process

Booking a holiday home on the Platform involves the following process:

  1. When you have chosen where you want to go, when you want to go and how many guests are attending, you select the holiday home of your choice to access its description.

  2. You will see the total price in the booking widget on the listing description.

  3. To proceed with your booking request (or direct booking) you are presented with a detailed summary of your booking details including price of each service (price, cleaning, insurance, etc.) and the total price for the booking, enabling you to check the details of your booking. It is your responsibility to ensure that all the information shown corresponds to the information you have provided.

  4. To complete your booking request (or direct booking) you must complete your personal information requested (name, email, home address and phone number). To finalize the booking request you must check that your booking details are correct and read the terms and conditions. If you book on behalf of a company, you accept that you represent and have the power of attorney/mandate to bind the company.

  5. You are now able to ask any questions you may have with the host through the dedicated chat.

  6. Information required to pay for the booking is presented immediately if your booking is a direct booking. If you have made a booking request, you will be presented with payment options as soon as the host has accepted your request. Read more about payment in section 11.

  7. You will receive an email with your booking confirmation, which formalises a binding agreement between you and the host for the rental of the holiday home.

If the rental amount is not paid in time, we will reach out to you via email, sms and/or phone. If we have not received the payment within 48 hours after your booking is confirmed the rental agreement between you and the host will be terminated with immediate effect. You can read more about the conditions for cancellation after payment in section 14 below.

6) Ranking your search results

When you search for a holiday home on our Platform, you will be presented with a search result based on your criteria such as location, dates and number of guests as well as other filters you may have chosen. Our goal is to deliver highly relevant search results as quickly as possible.

We present you with a list of relevant holiday homes based on various parameters, including:

  • location (in relation to your search)

  • the price or the discounted price of a holiday home

  • availability in relation to your search criteria

  • host response time, booking acceptance rate, and if the holiday home is instant bookable.

7) Chat

We provide a chat service enabling you to correspond with the host (or co-host) after you have made a booking request. This Service is only available if you have made a booking request through the Platform.

These messages are not public and are only intended for the recipient of the message.

You agree to use this chat service only in accordance with the legal provisions in force.

Landfolk monitors the content of messages, but cannot be held responsible for it under any circumstances.

We require hosts to provide accurate information and we apply certain screening procedures of hosts (including those required by law).

Under the exceptional circumstance Landfolk may assist in the chat between you and the host. In these events it will be clear to both parties that Landfolk participates in the chat.

8) Your obligations

You hereby undertake:

  • that you will use our Platform only for personal, non-commercial purposes (unless you have booked on behalf of a company). You undertake not to access the Platform and use the Services for purposes unrelated to the purpose of the Platform, or collect in any way whatsoever information about other guests or hosts, either manually or by automated means, without their consent, in particular to send unsolicited prospecting or spam, chain letters, etc.

  • that you will use our Platform lawfully and fairly, and by these terms, applicable laws and regulations, in particular, those relating to intellectual and industrial property, information technology and the protection of personal data

  • not to post, share or store any content that is 1) illicit, 2) contravenes freedom of the press or similar provisions of other jurisdictions, 3) inappropriate, violent, or of private nature, or 4) unrelated to the purpose of the Platform

  • make any false or fraudulent booking requests or representations

  • access, monitor or copy any content on our Platform using any robot or harvester. You may not develop or use software, devices, robots or any other means or technology to access, monitor and web scrape the Platform, the Services and any content on the Platform or to copy hosts’ profiles, extract holiday home listings or any other data available on the Platform

  • not to access or maintain, fraudulently, all or part of the Platform and to use a method of access other than the interface made available by Landfolk

  • do anything that imposes or is likely to impose an unreasonable or substantial load on our infrastructure

  • deep-link to any part of our Platform

  • reproduce, duplicate or otherwise incorporate any part of our Platform into another website

  • not to infringe or circumvent the security measures implemented, in particular, to protect the Platform or the servers on which it is hosted.

You are responsible for your use of the Platform, the Services and your actions on the Platform. You undertake to notify Landfolk of any malfunction of the Services or the Platform you observe.

9) Use of the holiday home

The holiday home may only be used for holiday purposes unless otherwise agreed with the host. No more people may stay in the booked holiday home than the maximum number stated in the approved booking, which includes children. Pets may only be brought if this is stated in the rental agreement between you and the host.

The holiday home must be used in accordance with the terms and conditions and any guidelines that the host has presented for the use of the holiday home, provided at the time of booking and/or arrival.

Special regulations may apply in the country where the holiday home is located, such as the use of pools, BBQ and heating devices.

If you as a guest do not comply with these terms and conditions, including the above guidelines, the legislation in force, public order in general at any time during the stay, the rental agreement may be terminated without notice and with immediate effect.

The price quoted prior to a booking request is based on a rental agreement with private use and does not apply to commercial use.

Commercial use

If your booking has a commercial purpose, such as a photoshoot, please contact support@landfolk.com. The host reserves the right to make a new price suggestion based on a description of the purpose.

10) Condition and facilities of the holiday home

The holiday homes on the Platform are privately owned and are furnished according to the host's personal style, taste, and needs. Therefore, the holiday homes are not identical, just as their furnishings and equipment will vary.

However, a holiday home will - unless otherwise stated in the listing - be equipped with:

  • Stove, coffee maker, cutlery, and kitchen utensils as a minimum for the number of persons allowed

  • Basic items that the guest is allowed to use such as salt and pepper, spices, oil, dish soap or /tabs (if the holiday home has a dishwasher), garbage bags, hand soap, basic cleaning products, and toilet paper

  • Toilet, cold and hot water, hand shower/shower cubicle, and toilet paper

  • Vacuum cleaner

  • Heating sources such as radiators or heat pump

  • Beds, duvets, and pillows

  • Waste container or similar. As these are emptied continually, the waste container cannot be expected to be empty on arrival.

The holiday home may be equipped with items other than those mentioned above. If there is any equipment in the holiday home other than that shown in the listing and above, including a TV, washing machine, tumble dryer or dishwasher, that is not working, we cannot guarantee that the repair can be made during your stay.

Please note that if the holiday home is listed as having a TV, there may not be any TV channels or streaming services available to you. If the host’s streaming services are available to you, you are not allowed to make purchases or rent films or the like unless the host has expressly agreed to this.

If the holiday home has a wood-burning stove, there will be firewood available for you to use for the initial lighting, so you can start enjoying your holiday from the moment you arrive. If you want additional firewood, you must buy it. If there is more firewood at the holiday home than for the initial lighting, it is the host's private property and may only be used if the host has given permission.

Charging of electric cars is not allowed in the holiday home for safety reasons unless it has a charging station installed for this purpose. Consumption for charging is not included in "normal consumption" (see section 11) and is therefore settled directly with the host. If you wish to use the charging station, you must arrange this with the host before arrival.

If you need special equipment, including equipment for children, you can contact the host directly through the chat in your booking and ask if the holiday home has such equipment.

The holiday home will be clean at the time of arrival, but unfortunately, the following may occur if the holiday home has been available for a shorter or longer period after cleaning:

  • there may be cobwebs in the holiday home on arrival, as they can quickly be made from hour to hour

  • there may be a damp and stuffy smell on arrival, which can be remedied by airing out thoroughly and then turning on the heat

  • windows of the holiday home may look dirty, and there may be sand, flies or similar on arrival, depending on wind and weather conditions.

If the above exceeds what can reasonably be expected, or the state of cleanliness is otherwise unsatisfactory, a complaint may be made in accordance with section 13 below.

It may happen that previous guests have had pets in the holiday home, even though pets are not allowed in the specific holiday home. In this regard, we point out that any allergic reactions resulting from this do not give the guest the right to cancel or terminate the rental agreement, nor are Landfolk responsible for allergic reactions. In general, we recommend that guests who have dust allergies choose homes with wooden or tiled floors.

In addition, disturbance from construction noise or other noise from the surrounding area of the holiday home may occur. The host or Landfolk cannot be held liable for this unless the host was aware of it and does not inform the guest before arrival.

11) Payment

Prices

When you book a holiday home, you agree to pay the full amount including all applicable taxes, any other items identified at the time of booking and all fees. The fees include utility costs, cleaning, insurance, and a service fee.

All rental prices on the Platform include utility costs (including electricity, heating, and water, but excluding EV charging). We encourage you as a guest to be responsible both to the host and the environment by only heating as needed, turning off a sauna after use and using the pool, spa, etc., in moderation.

Payment terms

You can pay by card or bank transfer. Please note that payments by bank transfer are not covered by the chargeback scheme.

The currency and the exact amount you agree to pay will be clearly displayed before you make a booking request (or direct booking). If you pay using a currency that differs from the currency set by the host for their holiday home, the price displayed to you is based on a currency conversion rate determined by Landfolk.

Some banks and credit card companies charge fees for international or cross-border transactions or currency conversion. If you have any questions about these charges or the exchange rate applied to your booking, please contact your bank or credit card company. The host or Landfolk is not responsible for, nor is it in any way associated with, charges related to variations in exchange rates or charges applied by credit card companies.

Taxes

Depending on the laws of the jurisdiction in which you and/or the host reside and/or in which the holiday home is located, the Total Price may be subject to or may include tourist taxes, which we may be required to collect and remit to the relevant local authorities based on the booking information.

Where applicable, we will provide you with an invoice or booking confirmation showing the amount of the taxes charged.

Laws may vary from one jurisdiction to another, it may be required that taxes be collected and remitted as:

  • a percentage of the rental price set by the hosts

  • a fixed amount per day

  • an amount based on the number of guests, or

  • according to other parameters.

Where required by law or authorized by tax and/or local authorities, we may collect and directly pay the applicable taxes on behalf of hosts to the relevant taxing authority.

If you are entitled to an exemption from taxes, you may send us a request with the required documentation and evidence in this respect.

If we have not collected on your behalf the taxes related to your booking (such as tourist tax), and that these are due as imposed by local authorities, these are at your expense and may have to be paid directly on site.

Instalment payment

When using our instalment payment service option if available, a fee is charged. You can pay in two instalments. The exact fee is specified at checkout and during payment through the Platform. In case of cancellation of the confirmed and paid booking, this fee is non-refundable.

If the second instalment is not paid on time the rental agreement will be terminated with immediate effect and the first instalment, minus the fee associated with the instalment payment, will be refunded.

Extraordinary energy surcharge

The host reserves the right to add an energy surcharge no earlier than 21 days and no later than 14 days before the check-in date, hereinafter referred to as the objection window, if there have been significant price increases in the electricity market between the request date and the objection window. This applies even if the stay is fully paid.

Significant price increases in the electricity market are defined as the average price of electricity in the seven days leading up to the objection window being at least double the average price of the calendar month in which the request was sent. The prices are taken exclusively from Nord Pool or the equivalent for the zone in which the holiday home is located.

If the host wishes to add an energy surcharge, the host will contact Landfolk, who will pass the energy surcharge on to the guest and arrange payment. The guest must be notified of the energy surcharge within the objection window by written notice to the guest via the guest's email or phone number.

If the host adds an energy surcharge, the guest is entitled, notwithstanding any other conditions described in section 14, to cancel the booking and have the amount paid refunded without undue delay and within 14 days of the cancellation. However, it is a condition that the cancellation is notified to Landfolk within 48 hours after the guest has been notified of the energy surcharge. Otherwise, the guest is considered to have accepted the energy surcharge.

12) Other obligations towards the host

Arrival- and departure time

Your booking confirmation includes arrival and departure times as well as information about when the holiday home will be ready for occupancy. Please be aware that it is not possible to access the holiday home earlier than agreed, and the holiday home must always be vacated by the departure time at the latest. If a late departure prevents a scheduled third-party cleaning from taking place, you as the guest will be charged 50% of the rental fee for the start day.

Arrangements for handing over the keys upon arrival must be made directly with the host.

Number of guests

When booking, the maximum number of persons in the holiday home will be indicated. If there are more guests in the holiday home than stated in the booking request, you are obliged to obtain written consent from the host. However, at no time may there be more persons in the holiday home than the maximum number indicated in the holiday home notice on the Platform. It is also not allowed to place a caravan, motorhome or pitch a tent on the site unless the host has agreed to this in writing.

Cleaning

With Landfolk, the final cleaning is always included, so you do not have to spend the last day of your holiday cleaning. However, you are obliged to keep the rented holiday home clean to the usual extent and must leave a tidy holiday home at the end of the rental period. This means, among other things, that you must:

  • do the dishes

  • empty the dishwasher and the fridge

  • remove hair and remnants from pets

  • remove ashes from the stove

  • tidy up cupboards

  • empty the rubbish bin and toilet bucket, and dispose of empty bottles/cans/glasses

  • clean garden furniture, put it in its place and put cushions back

  • clean the grill

  • arrange for general clean-up and placement of inventory as it stood upon arrival.

If contrary to expectations, the above is not complied with, any additional costs for cleaning and tidying will be charged. The cost of additional cleaning is €150.

Smoking

All Landfolk holiday homes are smoke-free. If smoking does occur inside the holiday home, you will be charged extra cleaning costs to restore the holiday home to its pre-smoking condition, including cleaning of walls, furniture, etc.

13) Complaints, defects, and deficiencies

Should anything fail to meet your expectations, either on arrival at the holiday home or during your stay, you as a guest are obliged to immediately contact your host. This gives the host an opportunity to rectify any possible deficiencies. Failure to complain within a reasonable time may mean that your right to claim the deficiency, including a claim for full or partial repayment of the rent or compensation, is lost.

In case of a complaint not resolved directly with the host, you need to inform Landfolk about the circumstances within 30 days after check-out. You need to send the required information to dispute@landfolk.com.

If Landfolk deems the complaint to be relevant, Landfolk will contact the host, who is obliged to rectify a justified defect within a reasonable time, unless the problem is due to your own circumstances. If the defect is not rectified, you should contact Landfolk as soon as possible and before departure via the above-mentioned email.

Please anticipate a processing time due to the evaluation of any potential claims.

Departure from the holiday home before the end of the rental period, without prior discussion or agreement with either Landfolk or your host, typically happens at your own expense and risk. Of course, we handle your case and assess it based on the applicable terms. A handling time due to the evaluation of your inquiry should be expected.

As a guest, you are liable to the host for any damage that you or your accompanied guests may cause to the holiday home, its furnishings and movable property during your stay. Should damage occur to the holiday home or keys be lost, you must inform your host and Landfolk immediately. Your stay includes insurance which is provided by a third-party insurer– you can read the full insurance terms here.

14) Withdrawal, cancellation, and modification

There is no right to withdraw from holiday home rentals on the Platform other than what follows from this section. By making a booking via the Platform, you accept and agree to the host's applicable cancellation policy, as well as the host’s other terms and guidelines.

The 48-hour withdrawal option

There is a 48-hour right of withdrawal for bookings with more than 72 hours to arrival. The right of withdrawal gives you the right to withdraw your booking within 48 hours of receiving confirmation of your booking request. You will receive a full refund, as long as there is more than 72 hours to arrival. You must withdraw your booking through the Platform, and contact the host via the chat. The withdrawal date is calculated from the date Landfolk receives the withdrawal on the Platform.

Cancellation policies after 48 hours from booking

If you wish to cancel your booking after the right of withdrawal has expired, please check your rental agreement and the cancellation policy provided by the host among the four options below. The exact terms and conditions that apply to the holiday home you have booked are specified at the time of your booking on the Platform.

Flexible

Guests are free to cancel their booking up to 14 days before the check-in date and receive a full refund of the Total Price. Guests can cancel the booking up to 7 days before the check-in date and get 50% of the Total Price refunded. Cancellations less than 7 days before the check-in date are non-refundable.

Moderate

Guests are free to cancel their booking up to 30 days before the check-in date and receive a full refund of the Total Price. Guests can cancel the booking up to 14 days before the check-in date and get 50% of the Total Price refunded. Cancellations less than 14 days before the check-in date are non-refundable.

Strict

Guests are free to cancel their booking up to 60 days before the check-in date and receive a full refund of the Total Price. Guests can cancel the booking up to 30 days before the check-in date and get 50% of the Total Price refunded. Cancellations less than 30 before the check-in date are non-refundable.

Super Strict

Guests are free to cancel their booking up to 60 days before the check-in date and get 50% of the Total Price refunded. Cancellations less than 60 days before the check-in date are non-refundable.

Change of dates on an existing booking

Depending on the availability of the holiday home, you may be able to change your booking if the host agrees. If you wish to extend, shorten or otherwise change your booking, please contact the host through the chat accessible on the Platform. The changes may affect your Total Price. Please note that if your requested dates are unavailable or the host cannot approve a date change, your original booking dates and the above cancellation conditions will remain in effect.

15) Force majeure

The host has the right to cancel the rental agreement if the host is prevented from making the holiday home available due to a force majeure event as defined by applicable law. In these events the host will not be liable for any failure or delay in performing their obligations under the terms and conditions or the rental agreement.

In case of force majeure, the Total Price will be refunded to you and you will not be entitled to claim any additional compensation.

Landfolk will, if possible, assist you in finding an alternative holiday home to rent.

16) Liability of Landfolk

Landfolk operates the Platform acting as an intermediary between guests and hosts. Landfolk is not a party to the rental agreement that you agree with the host through the Platform. The host, not Landfolk, is responsible for fulfilling the agreed rental agreement with you.

Landfolk cannot be held liable for:

  • the quality of the Service, the Service being offered “as is”

  • disruption or inability to use of the Platform

  • breaches of computer security, which may cause damage to your computer equipment and data

  • content posted online by another user, such as a host, insofar as Landfolk has no knowledge of such content as long as it has not been notified of its existence, in accordance with the provisions of applicable law

  • any direct or indirect damage that may result from accessing or using the Platform or the information contained therein, whatever its nature.

Landfolk makes every effort to provide up-to-date information. Landfolk shall not be liable for any errors or omissions. Any update, new service or new feature that improves or enhances one or more of the existing information contents shall be subject to these terms and conditions. Landfolk declines all responsibility concerning the decisions made by you solely based on information published on the Platform.

17) Your additional liability

You undertake to use the Services and all information to which you may have access only for purposes that are in conformity with public order, good morals and the rights of third parties.

You shall hold Landfolk harmless against any action, claim, demand or opposition, whatever its form, object or nature, on the part of any person invoking, in particular, an intellectual property right.

18) Intellectual Property

The Platform taken as a whole, as well as each of its components taken independently, in particular programs and specific developments and any content including data, text, still or animated images, logos, sounds, graphics, files, are the exclusive property of Landfolk, hosts or third parties who have granted Landfolk a license. These terms and conditions do not imply any transfer of intellectual property rights of any kind of elements belonging to Landfolk, such as sounds, photographs, images, texts, artistic works, software, trademarks, graphic charters, logos, etc.

The databases contained on the Platform are protected by applicable law, and any qualitatively or quantitatively substantial extraction or reuse of the content of these databases is prohibited.

The trademarks and logos appearing on the Platform are registered trademarks of the Landfolk or third parties. Any reproduction, imitation or use, in whole or partly, of these distinctive signs without express authorization and in violation of the prohibitions provided by applicable law shall engage the liability of their author.

Other distinctive signs, in particular corporate names, trade names, brand names, domain names, reproduced on the Platform are the property of Landfolk or third parties, and any reproduction without express authorization is likely to constitute usurpation engaging the responsibility of its author on the basis of applicable law.

Any total or partial representation of the Platform without the express authorization of Landfolk is prohibited and constitutes an infringement liable to engage the civil and criminal liability of the infringer, as provided by applicable law.

You agree in particular not to modify, copy, reproduce, download, broadcast, transmit, commercially exploit and/or distribute in any way whatsoever the Platform or the elements making the Platform.

Only use in accordance with the purpose of this Platform is authorized. Any other use not expressly authorized in writing and in advance by Landfolk is prohibited and constitutes an infringement.

Consequently, you shall refrain from any action likely to infringe, directly or indirectly, Landfolk's intellectual property rights.

Landfolk grants you a simple right to use the Platform. This right is revocable, free, non-exclusive and worldwide. It is intended for personal use under the conditions herein.

19) Data protection

The data processing carried out by Landfolk for the use of the Platform complies with the obligations provided for in Regulation (EU) 2016/679 (General Data Protection Regulation) of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data as currently in effect and as may be amended from time to time.

20) Hyperlinks

Landfolk reserves the right to set up hyperlinks giving access to websites other than those of its Platform. Landfolk declines all responsibility for the content of the information provided on these sites as a result of the activation of hyperlinks.

You may not create a link to the Platform without Landfolk's express prior authorization. Under no circumstances may such authorization be construed as an implicit affiliation agreement.

In any event, links to the Platform must be removed at Landfolk’s first request.

Landfolk declines all responsibility for the content of the information provided on these sites as a result of the activation of hyperlinks placed online by a third party.

21) Advertisement

Landfolk reserves the right to broadcast, free of charge or for a fee, advertising or promotional messages.

22) Proof agreement

Acceptance of these terms and conditions by electronic means has, between Landfolk and you, the same evidential value as agreement on paper.

Information which is required by law, or in application of professional rules and practices or the state of the art, with a view to the conclusion of the present terms and conditions, may be transmitted between the parties by email. The same applies to correspondence sent in connection with the performance of this agreement.

You expressly accept the use of this means as provided by applicable law.

23) Applicable law

Any dispute or claim arising in connection with the rental agreement, or breach or invalidity thereof, shall be governed by Danish law.

24) Jurisdiction

Any disputes arising out or in connection with the rental agreement, failing to be resolved amicably, shall be submitted to the exclusive jurisdiction of the defendant's place of residence, unless otherwise agreed between the guest and the host.

By booking a holiday home on the Platform, you agree to resolve all disputes between you and Landfolk concerning your booking and relating or referring to these terms and conditions, by sending a complaint to Landfolk at support@landfolk.com in order to find an amicable solution.

In the event of a dispute concerning these terms and conditions and the booking, complaints can also be submitted via the European dispute resolution platform.

Failing agreement through this procedure, the dispute will be submitted to the competent court of your place of residence, or of the place where the service was provided, or of the place where the event causing the damage occurred, or of the place where the damage was suffered, at your choice.

In the event of a dispute with a professional participant, within the meaning of applicable law, said dispute shall be submitted, failing amicable agreement between the Parties materialized by the execution of a settlement agreement within 30 days following notification by one of the Parties of the dispute making an express reference to this provision, to the exclusive jurisdiction of Danish Courts.
